With newly developed empirical methods and increased data availability, quantitative analyses can play an important role in antitrust and competition investigations undertaken by competition agencies. Quantitative analyses can complement the conclusions from qualitative or theory-based analyses, and provide an empirical basis to choose between competing conceptual or theoretical conclusions. The range of techniques used in competition analysis has expanded rapidly in the past two decades, and there is now an accumulated body of knowledge that is routinely brought to bear in competition matters in the United States and Europe. These guidelines are intended to provide a selective overview of current best-practice empirical methods, focusing on those that are most widely used and readily applicable at each stage of an empirical analysis involving competitive issues. The guidelines begin with an introduction to general best practices at each step of a typical empirical analysis and on the development of an economic model that will guide the analysis. We then describe a set of methods used to address some of the most common questions that arise in competition cases, including market definition; market concentration, upward pricing pressure, and other questions relevant to merger enforcement; empirically identifying the potential outcomes of alleged horizontal conspiracies; and market power and monopolization.

Con métodos empíricos recién desarrollados y un aumento en la disponibilidad de datos, el análisis cuantitativo puede jugar un papel importante en las investigaciones de las agencias de competencia. El análisis cuantitativo puede complementar las conclusiones de los análisis cualitativos o basados en la teoría y proporcionar una base empírica para elegir entre conclusiones conceptuales o teóricas. El rango de técnicas utilizadas en el análisis de competencia se ha ampliado rápidamente en las últimas dos décadas y actualmente se cuenta con un acervo considerable de conocimientos que habitualmente se toman en consideración en asuntos de competencia de los Estados Unidos y Europa. Estas directrices tienen la intención de proporcionar un panorama selectivo de mejores prácticas de los métodos empíricos actuales, centrándose en aquellas que se utilizan de manera generalizada y que son fácilmente aplicables en cada etapa de un análisis de casos de competencia.

This report provides a framework for evaluating the existence of market power, describes the tools that can be used for collecting and analyzing evidence on market power, and discusses practical issues that arise in applying the framework and tools to actual cases. This report is designed to serve two purposes. It is intended to provide the Mexican Federal Competition Commission (CFC) with a description of the prevailing international practices for assessing market power. It is also intended to provide businesses (and their legal advisors) guidance on how competition authorities generally analyze market power for the purposes of assessing the legality of practices or consolidations that businesses might be engaged in or contemplating.

Este informe está diseñado para cumplir dos propósitos. Por un lado, intenta proveer a la Comisión Federal de Competencia (CFC o Comisión) una descripción de las prácticas internacionales existentes para evaluar el poder de mercado. Por otro lado, está pensado para proveer a las empresas (y a sus asesores legales) de una guía sobre cómo las autoridades de competencia generalmente analizan el poder de mercado ante la posible legalidad de unas prácticas o de las concentraciones de empresas.

This report provides a framework for evaluating evidence for assessing the relevant market, describes some of the tools that can be used for collecting and analyzing evidence on the relevant market, and discusses practical issues that arise in applying the framework and tools to actual cases. A broad consensus has emerged among the world’s major competition authorities, as well as the community of antitrust scholars and practitioners, on how to approach market definition. This report largely reflects that consensus while highlighting some remaining sources of disagreement. Importantly, there is general agreement that market definition is not an end in itself but rather a process. There is also a consensus that mechanical approaches to market definition can lead to significant error. Therefore a flexible approach that rigorously weighs the available evidence in the context of the case at hand is needed. This report is designed to serve two purposes. It is intended to provide the Mexican Federal Competition Commission (CFC or Commission) with a description of the prevailing international practices for assessing the relevant market. It is also intended to provide businesses (and their legal advisors) guidance on how competition authorities analyze the relevant market for the purposes of assessing the legality of practices or mergers that businesses might be engaged in or contemplating.
