This report provides a general background on the supermarket sector, including definitions of different food-selling retail formats, a history of the transforming of the sector and the rise of chain supermarkets, a listing of the major players in the Latin American supermarket sector, and a discussion of common pricing strategies by supermarkets. The report also discusses competition issues in the supermarket sector, including horizontal collusion, abuse of dominance, vertical contracts, and buyer power. Special features of the supermarket sector are highlighted throughout, with recent cases from Argentina, Brazil, Canada, Chile, Costa Rica, Germany, Mexico, the U.K., and the U.S. Supermarket mergers and acquisitions are also discussed, as are vertical mergers of supermarkets and suppliers. The paper addresses some concerns to competition authorities which include the internationalization of the supermarket sector with the rise of regional and international chains; regulation, including food-safety regulation and zoning regulation; deceptive trade practices; and consumer resistance to market change.

En este documento se describen los problemas de competencia relacionados con la industria farmacéutica, centrándonos en la producción y distribución de medicamentos de venta con receta, incluyendo los medicamentos de patente y los genéricos. Los medicamentos de venta libre (OTC) se incluyen en un grado mucho menor. También se describen las principales características económicas de la industria farmacéutica que se relacionan con la política antimonopolio, incluyendo políticas regulatorias y de patentes, y el papel de las aseguradoras, los médicos y las farmacias minoristas que actúan como agentes o representantes de los pacientes/clientes. Examina brevemente los problemas de competencia en los países con sistemas regulatorios menos maduros y con predominio de mercados de pago particular o por cuenta propia de medicamentos para pacientes ambulatorios, y saca conclusiones.

This paper describes antitrust issues related to the pharmaceutical industry, focusing on the production and distribution of prescription drugs, including originator and generic products. OTC products are included to a much lesser extent. It also describes the major economic characteristics of the pharmaceutical industry that intersect with antitrust policy, including patent and regulatory policies, and the roles of insurers, physicians and retail pharmacies that act as agents for patients/customers. It briefly examines antitrust issues in countries with less mature regulatory systems and with predominantly self-pay markets for outpatient drugs, an draws conclusions.

In this paper we set out ways in which competition law can be applied to the telecommunications sector. The intended audience consists of officials in competition authorities in Latin American countries. Our goal is not to provide detailed guidance over how to conduct an investigation, to reach a decision and to run a case, but to outline the type of conduct which an authority might wish to investigate, to indicate the nature of the evidence that may be required to determine if the law has been broken, and to show in general terms how that evidence can be deployed in a decision document and defended in subsequent appeals. By way of illustration, we also summarize several past cases, drawn from Latin American, or in some instances, other jurisdictions.
